Set Aside at DUI/DMV Refusal Hearing

Our client, a Beverly Hills based entertainment executive, was arrested for DUI following a car accident in Beverly Hills.  He was also charged with refusing to submit to a chemical test at the hospital.  In the criminal case, Michael presented a mitigation package and negotiated a misdemeanor with probation and no custody time.  At the DMV hearing, our client testified and medical records were introduced to support our theory that he sustained head injuries and therefore lacked the capacity to refuse under applicable law.  The hearing officer agreed setting aside the action which saved our client from a one year actual suspension.
