Judge Grants Suppression Motion Resulting in Dismissal of DUI Charges

Our client was charged with DUI following his arrest in 2021. His blood alcohol was .22/20. CHP officers responded to a call of a man slumped over the steering wheel of a car “parked against a fence with the engine running.” Upon arrival, The CHP officer found the driver sleeping with the car in reverse and his foot on the brake. After several attempts to meet with a supervisor went ignored, Michael filed a suppression motion and set the matter for trial. In granting the defense motion, the Judge stated that the case law cited by the defense was precisely on point and that many of the facts testified to by the CHP officer were never raised in his report. Proof that cross-examination is the greatest tool to uncover the truth. Case dismissed!
